Terms & Conditions.

These terms and conditions (T&Cs) apply to all bookings with 45 Degrees North Ltd, 13 Fordbrdige road, Middlesex, TW166AH England. The T&Cs of this document together with your holiday booking confirmation received by email, comprise your agreement between 45 Degrees North Ltd and all those listed on the booking form. No contract exists until payment of deposit is received and processed.

Standard Terms and Conditions

Agreement.

These are the terms and conditions of 45 Degrees North Limited, Company Number 10792771, our Registered Office is 13 Fordbridge Road, Sunbury-on-Thames, United Kingdom, TW16 6AH. This agreement sets out what we can expect from each other when you buy Accommodation from us.

 

1. Booking your accommodation.

When you book your Accommodation services you are accepting this agreement on behalf of everyone travelling.

 When we say “you” and “your” we mean you, as the lead name, or you and another guest mentioned on your booking, depending on the context.

We will only deal with you, the lead name, and you must be an adult when you book. Anyone under 18 on your booking must be accompanied by an adult.

Our Agreement, includes our website, and the provisions of any applicable laws or regulations that apply to your booking. Our Agreement, and the details of your Accommodation in the booking confirmation, forms the entire agreement between us for your Accommodation.

 Our Agreement is made under the laws of England and Wales and you submit to the exclusive jurisdiction of those courts. You can choose the law and jurisdiction of Scotland or Northern Ireland but only if you live there. 

2.Payment schedule.

1.     Deposits

When booking we require a 30% deposit to secure the reservation with the remaining balance due 12 weeks prior to arrival.  This can be paid by either bank transfer or Paypal. Deposits must be received by 45 Degrees North within 5 days of making the provisional booking. If your deposit is not received in this time, we may offer the holiday dates to other interested parties. Upon receiving your deposit, we will send you confirmation of your holiday booking showing the deposit received and the balance and balance due date. The client who completes the booking form shall be liable for all those persons to whom the booking form applied.

 2. Balance payment

 The balance of your holiday must be settled 12 weeks prior to your arrival date. We will email you to prompt you for the final payment. If your holiday booking is made within 12 weeks of your arrival date, payment in full must be made immediately. If full payments are not made in accordance with this schedule, then bookings will be treated as cancellations and deposits will not be refunded.

3.Cancellation by you the customer.

 Your Obligation;
If you are obliged to cancel your holiday booking you must inform 45 Degrees North in writing immediately. You will incur costs on the following scale:

Over 10 weeks prior to departure: Loss of deposit.

10 – 6 weeks prior to departure: Loss of 60% of holiday cost.

6 – 4 weeks prior to departure: Loss of 80% of holiday cost.

Under 4 weeks prior to departure: Loss of 100% of holiday cost.

Cancellation by 45 Degrees North Ltd

45 Degrees North reserves the right to make alterations or cancel a booking entirely and refund all monies paid.  Whilst 45 Degrees North will endeavour to make every effort that this does not happen, if it is completely unavoidable, we will contact the group leader immediately.  If this does happen we will endeavour to make alternative arrangements for the same value for accommodation if available or offer a full refund.  45 Degrees North accepts no legal liability and will pay no other compensation. No form of compensation or refund will be paid if a cancellation is caused by events amounting to Force Majeure (Force Majeure such as warfare, riots, civil unrest, terrorist activity, industrial dispute, weather, lack of snow, road closures, including access roads to Morzine, epidemics, natural or technical disasters, nuclear war or similar events out with our control.)

4.Liability.

45 Degrees North Ltd does not accept any liability for or pay compensation for:

Any event or circumstance that 45 Degrees North could not foresee or avoid, amounting to Force Majeure such as warfare, riots, civil unrest, terrorist activity, industrial dispute, weather, lack of snow, road closures, including access roads to Morzine, epidemics, natural or technical disasters, nuclear war or similar events out with our control.

Any financial loss or damage to property suffered to you the customer other than due to negligence by the company.

Any temporary defect or stoppage in the supply of public services to the property, nor in respect of any equipment, machinery or appliance in the property or garden.

Delays, missed flights or resulting costs incurred by the client due to circumstances out of their control with regards to airport transfers. These circumstances can include but are not limited to, the following examples: Road traffic accidents causing delays, vehicle breakdown, severe weather conditions, deaths or accidents causing injury on the roads, unforeseen problems caused by other passengers or any action of a third party that damages vehicles.

 Any cancellation, loss, delay or costs arising from or connected with adverse weather conditions, avalanche, landslides, snow conditions and the effect these have on the travel arrangements, accommodation or activities.

Any limitations imposed by the resort authorities, ski-lifts, the ski schools or the ski hire operator.

 Any loss or damage or inconvenience caused to the customer if the chalet is damaged or destroyed before the start of the holiday, in such an  event 45 Degrees North will endeavour to refund all sums previously paid in respect of the holiday.

 Your Accommodation is provided by us in accordance with local standards. If anyone travelling suffers injury, illness or death while you are staying at the Accommodation that you have booked, you must tell us about it and complete a report at the time

 

Your responsibility.

 

5.Insurance.

Before coming on holiday with 45 Degrees North, all guests must be covered by suitable sports travel insurance including medical cover. It is the responsibility of every guest to ensure that their insurance policy covers all elements of their holiday. 45 Degrees North will not take responsibility for guests whose insurance policies do not provide sufficient cover for their requirements. Guests may be required to show their insurance documents on arrival in resort. Guests without proof of sufficient cover will be obliged to find a suitable insurance policy immediately. 45 Degrees North will not be held responsible for any incident that occurs whilst a guest has insufficient insurance cover.

 

6.Guest Information.

You must ensure all information you give is correct and tell us if any of it changes. By providing other people’s personal data, you must be sure that they agree to share their data with us. All details provided by you will be used in accordance with our Privacy Notice.

If you give us your email address, we’ll contact you that way but you may still have to contact us via our telephone numbers.

You must pass on any important safety and travel information we give you to everyone on your booking.

You must comply with all passport, visa and other immigration requirements.

 

7.Security.

 Chalet security is an important issue for us and we will encourage all guests to assist us with this. However, due to the nature of chalet holidays it is possible that the buildings may not be locked at all times. Please be aware that there will also be shared use with other guests and staff of the entrance door. You must take reasonable precautions for your own safety while on holiday. Keep all your valuable belongings with you and supervised at all times. We cannot accept responsibility for the lost of personal possessions during your stay with us.

 

8.Behaviour.

 45 Degrees North expects all our guests to conduct themselves in an orderly and acceptable manner and to have consideration for their fellow guests and surrounding neighbours. Excessive noise inside or outside the chalet outside of 10pm will not be tolerated. No smoking is also permitted in the chalet at anytime.

 45 Degrees North reserves the right to refuse to further accommodate any guest guilty of behaviour that we deem to seriously impair the enjoyment of other guests or which threatens the condition of the chalet. The guilty party will be liable for the cost of any damage so caused. Full payment for any such damage must be made at the time to ourselves at a rate of cost determined by 45 Degrees North, or any third party involved. If payment is not made then the guilty party must indemnify us against any claims (including legal costs) subsequently made against us as a result of their actions.

 

9.Children.

No matter how much care is taken, our chalets are not childproof. 45 Degrees North will not be held responsible for any accidents occurring within the chalets or premises. It is the parents’ responsibility to ensure their children are supervised at all times. Particular care must be taken with hot tubs, fire places, chimneys and staircases as fire-guards and stair-gates are not provided.

 

10.Pets.

 No pets are allowed to be brought on to the property unless permission has been granted by 45 Degrees North.

 

11.Hot tubs.

Prior to guests arriving, hot tubs are cleaned and the water changed. This means the hot tub will be cold on arrival and will be ready for use the following evening.
Water quality and cleanliness are also monitored 3 times a day throughout the week. Whilst 45 Degrees North will endeavour to ensure the health and safety of guests using the hot tub, we cannot guarantee it.

Guests use hot tubs at their own risk and special care should be taken at all times, especially when getting into and out of the hot tub. Extra care should be taken during cold and icy conditions as the areas surrounding the hot tubs cannot be salted to remove ice.
45 Degrees North presumes that all guests, before using the hot tub, have read and understood the Hot Tub rules that are posted within the chalet.

We recommend that children under the age of 12 years of age do not use the hot tub. Children must be supervised by an adult at all times to avoid the risk of drowning and/or overheating.

45 Degrees North reserves the right to close hot tubs for reasons related to, but not limited to, damage, chemical imbalance, breakdown, vandalism or unsafe conditions. Prior notice is not necessary and in such cases compensation will not be payable to guests.

 

12.If you have a complaint.

It is very rare for things to go wrong. If they do, you must tell us or our representative straight away so they can solve the issue. If we or our representative aren’t available, you should contact us on hello@45degreesnorth.co.uk.

 

13. Self Catered Accomodation

Any loss or damage  caused  by the Group Leader or members of the group to the property (including fixtures and fittings) and/or grounds and outbuildings will be deducted from the damage deposit and the remainder returned. Any damage costing above the damage deposit must be paid in full by the Group Leader on behalf of the Group irrespective of which person was responsible, within 14 days of confirmation of the amount. When it has been confirmed there is no damage to the property, the damage deposit will be refunded 7 – 14 days after departure.

Additional guests are not permitted to stay in the Self Catered Property other than those specified on the Booking Form. Failure to comply with this may result in your booking being terminated immediately in resort and you and your party may be asked to vacate the relevant Self Catered Property immediately. No compensation will be paid for this.

It is up to the Group Leader to ensure that the self-catered accommodation is left clean and tidy on departure and check out instructions are adhered to. If this is not the case an additional charge for unreasonable cleaning time may be charged.

It is the responsibility of the Group Leader to notify Us within 24 hours of arrival of any damage found in the accommodation. Any damage not notified will be assumed to be caused by the Group.

45 Degrees North only includes linen, towels, and cleaning of the property before and after your stay within the price of your self catered holiday.

MODIFICATIONS OF THE TERMS AND CONDITIONS

These terms of Our Agreement may be varied at any time by us at our discretion. In this case, the new terms of Our Agreement will be available on our website and will automatically apply to you with immediate effect, except for if you booked your Accommodation with us before the date of publication of the new terms, in which case the previous accepted version of Our Agreement remain applicable.
